WHY IS WEEE IMPORTANT IN THE EU?

WHICH PRODUCTS FALL UNDER THE WEEE SCOPE?

Since 15 August 2018, the WEEE Directive has classified EEE into six main categories:

• Temperature exchange equipment: refrigerators, freezers, air-conditioning equipment, heat pumps and similar products.
• Screens, monitors and equipment containing screens: televisions, computer monitors, laptops and equipment with screens larger than 100 cm².
• Lamps: certain types of lamps, including relevant fluorescent and LED lighting products.

• Small equipment: equipment with no external dimension greater than 50 cm, including various small household and electronic appliances.

However, not every electrical product automatically falls within the scope of WEEE. The Directive also specifies a number of exclusions and special cases. Therefore, businesses should assess each product and its intended use before determining the applicable WEEE obligations.

WHO IS CONSIDERED A “PRODUCER” UNDER WEEE?

One of the most important aspects for businesses exporting to the EU is that the term “Producer” under WEEE does not simply refer to the company that physically manufactures a product.

Depending on the business model and the applicable national legislation, a company may be considered a Producer if it:

• Manufactures and sells electrical or electronic equipment under its own brand;
• Resells equipment under its own brand even though it was manufactured by another company;
• Places EEE from a non-EU country or another EU Member State on the market of a Member State;
• Sells EEE directly to users in an EU Member State through distance selling, depending on the applicable requirements.

This is particularly important for Vietnamese companies selling products directly into the EU. The fact that a product is manufactured in Vietnam does not automatically mean that the company has no WEEE obligations.

Businesses need to determine who places the product on the market in each EU country, how the product is sold, and what role the company plays in the supply chain.

WEEE REGISTRATION AND EPR IN THE EU

An important part of WEEE Compliance is Producer registration and the implementation of Extended Producer Responsibility (EPR).

The WEEE framework requires EU Member States to establish registration systems for producers and systems for collecting and reporting information relating to EEE and WEEE. Producers may also have financial responsibility for the collection, transportation, treatment, recovery and environmentally sound disposal of WEEE, depending on the applicable national requirements.

Since 2019, the collection target has been at least 65% of the average weight of EEE placed on the market in the preceding three years or 85% of WEEE generated in the territory, depending on the calculation method applied under the Directive.

WHAT IS THE DIFFERENCE BETWEEN WEEE AND ROHS?

WEEE and RoHS are often mentioned together because both apply to electrical and electronic equipment. However, they address different areas of environmental compliance.

A simple way to understand the difference is:

RoHS focuses on “what is inside the product”, while WEEE focuses on “what happens to the product when it becomes waste”.

Therefore, WEEE and RoHS should not be considered interchangeable requirements. A product may need to comply with both frameworks when it falls within their respective scopes.

This guide explains, in practical terms, what the ILS Program requires, how the FAMA process works, which assessment pathway applies to Vietnam, and how manufacturers can prepare efficiently while avoiding the most common — and costly — mistakes.

1. What Is Disney ILS and Why Does It Matter?

Disney’s International Labor Standards (ILS) Program is the labor and workplace-conditions framework that The Walt Disney Company applies across its entire global supply chain — currently spanning roughly 40,000 facilities in nearly 100 countries. The Program requires Licensees and Vendors to ensure that facilities producing Disney-branded goods conduct regular ILS Audits and provide ILS Audit Reports, as set out in the ILS Program Manual (current edition: January 2024, subject to periodic revision). Disney manages Program requirements, statuses, and communications through its “Compass” system, accessible to authorized Licensees, Vendors, and their designated ILS Representatives.

The principles behind the Disney Code of Conduct for Manufacturers — the foundation of the ILS Program — are aligned with the core conventions of the International Labour Organization (ILO), covering child labor, forced labor, harassment and abuse, discrimination, freedom of association, workplace health and safety, and transparency.

2. FAMA: What It Is and What It Is Not

Facility and Merchandise Authorization (FAMA) is the authorization Disney issues to a specific Disney Licensee or Vendor to use a specific facility to produce a defined scope of Disney-branded merchandise.

It is important to understand what FAMA is not:

• It is not a general facility management-system certificate (unlike ISO 9001 or BSCI).
• It does not automatically transfer if the facility begins working with a different Licensee or Vendor.
• It is not issued automatically just because a facility passes an audit — Disney retains full discretion to accept, reject, or request clarification on any assessment report, and to inspect the facility at any time.

Crucially, the facility itself does not submit the FAMA Application. The Licensee or Vendor holding the contractual relationship with Disney is responsible for completing and submitting the FAMA Application through their designated Disney ILS Representative. This means the very first step for any manufacturer is to identify the correct Licensee/Vendor, deal or contract number, and ILS Representative — without this information, no assessment pathway can proceed to a valid FAMA outcome.

3. The Minimum Compliance Standard (MCS)

MCS is the compliance floor a facility must meet to be considered for Disney-branded production. It covers several critical areas:

Meeting MCS does not mean a facility has zero findings — non-conformities outside the MCS threshold still require continual improvement — but MCS violations are the “red lines” that can result in outright rejection of a FAMA application.

4. Requirements: Two Valid Assessment Pathways

Under Disney’s Country-Specific Submission Requirements Supplement, Vietnam is classified as a Permitted – Audit Required sourcing country. Within this classification, two assessment pathways apply, and choosing the correct one is essential:

Pathway A — Better Work Vietnam. Better Work — a joint program of the ILO and the International Finance Corporation (IFC) — operates in Vietnam, and factory participation in the garment/footwear sector is optional. From 12 August 2026, the EU Packaging and Packaging Waste Regulation – PPWR, Regulation (EU) 2025/40 – enters its first phase of direct application, bringing strict PFAS (“forever chemicals”) limits for food-contact packaging alongside broader requirements on recyclability, recycled content, packaging minimisation and technical documentation. Unlike a directive, a regulation has direct legal effect across all 27 EU member states and applies regardless of where the packaging is manufactured – which means exporters of plastic, PP woven, paper and metal packaging are directly in scope the moment their goods are placed on the EU market.

This article explains what PPWR and its PFAS provisions mean in practice, and how ISC Global, together with its certification partner, supports manufacturers in building a defensible, cost-effective compliance file.

1. What PPWR Actually Requires

PPWR replaces the earlier EU Packaging Directive (94/62/EC) with a single, directly applicable regulation. Its core obligations include:

• Control of substances of concern, including heavy metals (lead, cadmium, mercury, hexavalent chromium) and, for food-contact packaging, PFAS.
• Recyclability requirements and, from 2030 onward, recycled-content targets for plastic packaging.
• The packaging minimisation principle – packaging must not exceed what is necessary for its function.
• Harmonised labelling obligations from 2028 onward, per Article 12 and related implementing acts.
• A technical documentation file structured under Annex VII, supporting the manufacturer’s own EU Declaration of Conformity (EU DoC).

Under Article 5(5) of PPWR, food-contact packaging may not be placed on the EU market if PFAS levels meet or exceed any of the following thresholds:

Determining whether a given packaging line is “food contact” must be based on its actual intended use, not merely on the product’s marketing description – a distinction that matters especially for woven PP bags used for agricultural produce, animal feed, or minerals, where the same base material may serve multiple end uses with different regulatory implications.

The EU’s recommended testing pathway is a three-step approach: Total Fluorine (TF) screening first; if TF exceeds 50 mg/kg, a method to differentiate organic (PFAS-related) fluorine from inorganic fluorine follows; and where needed, targeted PFAS/TOP analysis is performed by an ISO/IEC 17025-accredited laboratory to assess the 25 ppb and 250 ppb thresholds precisely.

3. There Is No Mandatory “PPWR Certificate” – Here’s the Actual Legal Model

A common misconception among both exporters and buyers is that PPWR requires a CE-style certificate issued by a notified body. It does not. Packaging falls under Module A – Internal Production Control: the manufacturer performs (or commissions) the conformity assessment, prepares the technical file, and signs the EU DoC directly, per Articles 15, 38-39 and Annex VII of Regulation (EU) 2025/40. Legal responsibility cannot be transferred to a consulting firm or an assessment partner.

That said, an independent third-party verification – based on document review, sampling and laboratory test reports – provides valuable supporting evidence. It signals to EU buyers that a supplier’s compliance claims have been checked by an independent party rather than self-declared alone, without overstating the legal status of that verification.

For Vietnamese businesses already exporting — or planning to export — to the EU market, this is no longer an optional “green trend” but a mandatory technical barrier that could determine whether your shipment clears customs at all.

1. WHAT IS THE PPWR, AND WHY DOES IT MATTER MORE THAN YOU THINK?

The PPWR — the Packaging and Packaging Waste Regulation, officially Regulation (EU) 2025/40 — is the EU’s new legal framework governing the entire lifecycle of packaging, from design and manufacturing through to collection and recycling. It entered into force on 11 February 2025 and will generally apply across the bloc from 12 August 2026, fully replacing Directive 94/62/EC, which had been in place for over three decades.

The key distinction lies in its legal nature: the PPWR is a Regulation, not a Directive. This means it applies directly and uniformly across all 27 EU member states, without the separate national transposition process required in the past — no more slightly different packaging rules from one EU market to another. For exporters, this cuts both ways: it’s good news (one single standard for the entire bloc) but also raises the stakes (no country-specific loopholes or exceptions).

Most importantly: the PPWR applies to any product with packaging placed on the EU market, regardless of where that product was manufactured. A PP woven-bag factory in Nghe An, a pipe manufacturer in Ho Chi Minh City, or an agricultural export processor in the Mekong Delta — all fall within scope if their goods’ packaging circulates in the EU.

2. THE THREE PILLARS OF THE PPWR

The PPWR is built around three overarching objectives:

1. Making all packaging on the EU market economically recyclable by 2030 — meaning packaging must not only be “technically recyclable” but recyclable at a reasonable cost under the real-world conditions of existing collection and sorting infrastructure.
2. Increasing the safety of recycled plastics used in packaging — ensuring recycled material is free of contaminants and harmful chemical residues.
3. Reducing the use of virgin plastic, steering the packaging industry toward climate neutrality by 2050.

Alongside these, the Regulation sets targets to cut per-capita packaging waste: 5% by 2030, 10% by 2035, and 15% by 2040, benchmarked against 2018 — forcing businesses to rethink packaging design toward minimalism.

3. SPECIFIC TECHNICAL REQUIREMENTS BUSINESSES NEED TO KNOW

• Design for Recycling (DfR): From 2030, packaging must be rated on an A–B–C scale based on actual recyclability. Packaging rated poorly or failing minimum criteria will be removed from the EU market.
• Mandatory recycled content: Food-contact plastic packaging must contain at least 30% recycled plastic by 2030, rising to 50% by 2040; other plastic packaging must reach 35% by 2030, rising to 65% by 2040.
• Single-use plastic restrictions: bans on certain single-use packaging formats for individual portions (e.g. single-serve condiment/sauce sachets).
• Right to bring your own container: takeaway food and beverage businesses must allow customers to use their own reusable containers without an extra charge.
• Control of substances of concern — including PFAS: restricts PFAS in food-contact packaging above the regulatory threshold (detailed below).
• Empty-space limits: applying particularly to e-commerce packaging, to reduce wasted packaging material and unnecessary shipping costs.
• EU-wide harmonised labelling: a unified labelling system for materials and waste-sorting instructions, rolling out between 2027 and 2030.
• Deposit Return System (DRS): applicable to certain beverage and takeaway packaging sectors, requiring specific reuse rates to be achieved.

4. KEY TIMELINE FOR BUSINESSES TO REMEMBER

The 12 August 2026 deadline deserves particular attention, as this is when the majority of core compliance obligations — including PFAS control — become legally binding.

5. PFAS — THE “FOREVER CHEMICALS” HIDING IN PACKAGING

What is PFAS, and why is it a concern?

PFAS (Per- and polyfluoroalkyl substances) are a class of synthetic chemicals containing carbon–fluorine bonds — among the strongest chemical bonds in organic chemistry. Because of this stability, PFAS barely break down in the natural environment, persisting for generations even after emissions have completely stopped — which is why they’re known as “forever chemicals.”

PFAS are widely used for their oil-repellent, water-repellent, and heat-resistant properties — especially common in paper, box, and food-bag packaging that requires grease resistance (such as fast-food containers or paper bags for oily food).

Health and environmental risks

Scientific studies have linked PFAS exposure to a range of serious health concerns: thyroid disease, several types of cancer (breast, liver, kidney, testicular), inflammatory bowel disease, and effects on unborn children such as delayed development, lower birth weight, and increased miscarriage risk. Environmentally, PFAS persist and accumulate in soil, water, air, and the food chain, causing widespread ecosystem disruption.

The European Commission estimates that if current PFAS pollution levels continue through 2050, the cost to society will reach €440 billion — while early action to reduce releases at source could save up to €110 billion. This is why the EU is tightening PFAS control on multiple fronts: drinking water, soil, industrial emissions, and now food-contact packaging through the PPWR.

How must businesses prove compliance?

This is a point businesses frequently overlook: the PPWR does not accept self-declaration. To demonstrate that packaging meets the permitted PFAS threshold, businesses must obtain test results from an accredited, independent laboratory.

The recommended testing pathway typically involves two steps:

1. Total Fluorine (TF) screening — a general-purpose, lower-cost test that provides a quick assessment of overall risk.
2. Targeted PFAS compound analysis — only required if the TF screening result exceeds the alert threshold, in order to precisely identify the specific compound and its concentration. This step is significantly more expensive than the initial screening.

Because of this two-step mechanism, total testing cost cannot be fixed in advance of the screening result — something businesses should account for when budgeting for compliance.

6. WHY VIETNAMESE EU EXPORTERS CANNOT AFFORD TO SIT THIS OUT

Many Vietnamese packaging, consumer goods, agricultural, and processed-food manufacturers still assume EU regulations “only apply to European companies.” This is a costly misconception. As noted above, the PPWR applies to any product with packaging placed on the EU market, regardless of manufacturing origin. This means:

• A shipment of woven PP packaging exported to Germany, the Netherlands, or France must fully comply with PPWR requirements exactly as if it were manufactured within the EU itself.
• If packaging fails to meet the PFAS threshold or design/recyclability requirements, goods can be refused entry right at the port of import, resulting in serious losses in time, storage costs, and reputation with trading partners.
• The PPWR also ties into the Extended Producer Responsibility (EPR) mechanism under an “ecomodulation” approach — more sustainable packaging incurs lower EPR fees, while less sustainable packaging faces higher fees. This is both a mandatory cost and a competitive lever for businesses that adapt early.

In short, the PPWR is both a compliance risk requiring careful management and a differentiation opportunity for businesses that prepare thoroughly ahead of their competitors.
