Why chemical investment in Vietnam is a “multi-compliance” project

A single aerosol can or industrial chemical product may be regulated across many legal disciplines at once. Approaching it as isolated “permit applications” often leads to out-of-sequence investment, facility retrofits, added cost and delays.

Typical disciplines and authorities (after the 2025 State-apparatus restructuring):

  • Enterprise & investment: business registration now sits with the Department of Finance (after the former Department of Planning & Investment was merged in).
  • Chemicals: Ministry / Department of Industry and Trade (Chemicals Agency) — licensing, declaration, chemical management.
  • Environment: Ministry / Department of Agriculture and Environment — environmental dossiers, permits, hazardous waste.
  • Fire safety: Fire Police (Ministry of Public Security) — appraisal and acceptance.
  • Customs: import of raw materials and export of finished goods, plus sector authorities depending on the product.

Successful delivery therefore requires integrated coordination, not stand-alone licensing.

The updated legal framework you must know (2026)

Several rules have changed fundamentally. Using outdated documents can force a full re-work of your files.

Chemicals – SDS – GHS

  • Law on Chemicals 69/2025/QH15 (effective 01/01/2026), replacing the 2007 Law.
  • Decrees 25/2026/NĐ-CP and 26/2026/NĐ-CP, and Circular 01/2026/TT-BCT (GHS classification, labelling and Safety Data Sheets).
  • Key changes: the new “special-control chemicals” category; electronic chemical declaration via the National Single Window; a compliance deadline of 31 December 2026 for special-control chemicals.

Environment – VOC – EPR: Law on Environmental Protection 2020; Decree 08/2022/NĐ-CP (as amended); Circular 02/2022/TT-BTNMT (packaging EPR).

Fire safety: Law on Fire Prevention, Fighting & Rescue 55/2024/QH15 (effective 01/07/2025); Decree 105/2025/NĐ-CP; QCVN 06:2022/BXD; TCVN 5507:2021; NFPA 30B reference for aerosol manufacturing and storage.

Labelling & export: Decrees 43/2017 and 111/2021 (mandatory GHS labelling); EU REACH & CLP, Aerosol Dispensers Directive 75/324/EEC; US TSCA, Proposition 65, EPA VOC; dangerous-goods transport — aerosols classified as UN 1950 (IMDG / IATA DGR / ADR).

The CIRCP™ two-phase model

To optimize cash flow and control risk, ISC Global delivers the project as a compliance project in two phases.

Phase 1 — RDIRA™: Regulatory Due Diligence & Investment Readiness Assessment

Duration: 4–6 weeks. Before committing major capital, you learn whether the project is regulatorily feasible, which conditions and permits apply, in what sequence, what risks exist and the expected compliance budget. Phase 2 — Compliance Project Management

Duration: 6–18 months. ISC Global coordinates and manages all workstreams so the enterprise becomes legally ready to operate: support for the incorporation dossier; chemical classification, Chemical Register, SDS, GHS and labels; coordination of environmental and fire-safety dossiers with specialist units; chemical-licensing support; management-system build (SOPs) and training; and export compliance.

Frequently Asked Questions (FAQ)

1. Do I need a special licence to manufacture chemicals in Vietnam? It depends on the chemical. After classification under Law 69/2025, you may need a Certificate of Eligibility for chemical production/trading (for conditional chemicals) or a licence for special-control chemicals, alongside declaration, labelling and SDS obligations.

2. When and where must chemicals be declared? Imported chemicals subject to declaration are filed electronically via the National Single Window under the guiding regulations of the 2025 Law on Chemicals.

3. Does ISC Global guarantee that permits will be granted? No. ISC Global provides advisory, review, documentation and coordination. Permit issuance depends on the dossier, the project’s actual conditions and the competent authorities’ decisions.
